These General Subscription Terms (GST) define the rights and obligations of subscribers to the services provided by BATAL SAS. By subscribing to a plan, you agree to the following terms.

Article 1 - Purpose:

The GST regulate the subscription, use, and management of the subscription plans offered by BATAL SAS, particularly for boat management, maintenance, and rental services.

Article 2 - Subscription to a Plan:

Article 2.1 Eligibility

Subscriptions are available to boat owners who are of legal age and have full legal capacity.

Article 2.2 Subscription Process

The client selects the subscription plan that best suits their needs through the website or a physical contract. The subscription becomes effective after payment validation and mutual contractual agreement.

Article 2.3 Rights and Renewal

In accordance with consumer protection laws, the client has a 14-day withdrawal period from the subscription date, except if the service has started with their explicit consent.

Article 3 - Duration and Renewal:

Article 3.1 - Initial Term

The minimum subscription period is specified in the contract (e.g., 12 months).

Article 3.2 - Renewal

The subscription is automatically renewed at the end of the initial term, unless the client cancels in writing at least 30 days before the expiration date.

Article 3.2 - Early Termination

The client may terminate their subscription before its expiration only in cases of force majeure or by paying a cancellation fee of 20% of the remaining balance.

Article 4 - Pricing and Payment:

Article 4.1 - Initial Term

Subscription prices are detailed in the commercial offer. BATAL SAS reserves the right to adjust prices due to cost variations, with a 30-day prior notice.

Article 4.2 - Renewal

Payment can be monthly or annually, depending on the selected option. Payments are made via direct debit or bank transfer.

Article 4.3 - Late Payments

In case of non-payment, late fees apply (1.5% per month) and services may be suspended until payment is settled.

Article 5 - Services Included in the Subscription:

The services included in each subscription plan are detailed in the contract and may include:

Administrative and rental management of the boat.
Monitoring and execution of maintenance operations.
Access to an online client space for tracking performance and detailed reports.
Dedicated customer support.

Additional à la carte services (not included) may be offered upon request.

Article 6 - Obligations of BATAL SAS:

BATAL SAS commits to:

Providing services in accordance with the contract.
Ensuring full transparency through regular reports.
Guaranteeing data security and proper functioning of digital tools.

Article 7 - Obligations of the Client:

The client commits to:

Paying the amounts due as per the contractual terms.
Providing all necessary documents for boat management (registration certificate, insurance proof, etc.).
Informing BATAL SAS of any changes that may affect service execution.

Article 8 - Termination:

Article 8.1 - By the Client

The client may terminate their subscription under the terms defined in Article 3.

Article 8.2 - By BATAL SAS

BATAL SAS reserves the right to suspend or terminate a subscription if the client violates the GST, following a 15-day formal notice without resolution.

Article 8.3 - Consequences of Termination

Upon termination, all services will be suspended and client-related data will be deleted in accordance with the Privacy Policy.

Article 9 - Modifications to the GST:

BATAL SAS may modify the GST to adapt to legal or technical changes. Any modification will be communicated to the client with a 30-day notice.

Article 10 - Disputes and Applicable Law:

Article 4.1 - Applicable Law

The GST are governed by French law.

Article 4.2 - Disputes

In case of a dispute, an amicable resolution will be prioritized. If no agreement is reached, the dispute will be referred to the competent courts of BATAL SAS’s registered headquarters.
